"Active Shooter and How to Respond: Guidance for Surviving the Incident" Presented by: Sgt. Robert Wondra Description of presentation:

This presentation will familiarize attendees with definitions used in describing Active Killer situations as well as a mental permission slip to use if the incident were to occur where they were located. This presentation will also discuss potential behavior indicators to the active killer so that management, human resources and co-workers can possibly identify ("if you see something, say something") and intervene early to prevent an incident or help co-workers receive the treatment that they may need. And this presentation will identify possible methods and techniques to train your staff so that they can conduct successful drills targeted to help them survive the incident.

StrategicHealthSolutions, LLC Retains Long-Standing Education and Outreach Contract with Medica

January 30, 2013 - StrategicHealthSolutions, LLC (Strategic) will continue to produce educational materials for the Medicare Learning Network® (MLN) under a long-standing contract with the Centers for Medicare & Medicaid Services (CMS).

CMS recently awarded the Medicare Outreach and Quality Assurance contract to Strategic - first awarded to the company in 2008 - based on Strategic's exceptional customer service, cost-consciousness, and commitment to quality products. CMS awarded the re-competed contract for another three years.

Under this contract, Strategic will continue to support the MLN in the design, development, and production of plain language educational materials for Medicare Fee- For-Service Providers. These materials will include fact sheets, booklets, and web-based
training courses that cover Medicare benefits, coverage, and billing as well as information about improving the health and quality of life for Medicare beneficiaries.

The contract also requires Strategic to create Continuing Education (CE) training for healthcare professionals. Strategic, an accredited national provider of CE, will support CMS to ensure all training meets provisions required by designated professional associations and organizations.

Strategic's workload and work force have increased significantly under this contract in the past five years. Strategic currently supports 70 percent of CMS' MLN products.

"Carnival of Love" is the theme of the 2013 annual Heartland Family Service gala, hosted by the agency's Friends guild. The Feb. 16, 2013 fundraiser will be held at the Embassy Suites Hotel & Conference Center in La Vista at 6 p.m. Valet parking, cocktails, hors d'oeuvres, carnival games, live and silent auctions and dinner make this evening memorable.

The gala will have great carnival games including a wine toss, basketball shoot, and photo booth. The event will also feature some fabulous auction items including a ticket package to the Justin Beiber concert, a trip to this year's Master's Golf Tournament, an Exclusive and Rare Wine Collection and a package that includes four tickets on the 50-yard line to the 2013 Nebraska vs. Iowa football game. Previously, Gorham spent two years in the design sales industry at Beaver Creative Environment in Kansas City. Other experience includes five years with large design and multidisciplinary firms in Omaha and Dallas, Texas.

He has a Bachelor of Landscape Architecture degree from Kansas State University and is currently pursuing a Master of Business Administration degree from UNO with the hope of broadening his skill set as an industry professional. Sometimes businesses ask employees to sign a non-compete agreement at some point in their employment. Nebraska Courts have narrowly defined the permissible scope of covenants not to compete contained in employment agreements to include only "customer specific" restraints.

For example, in Polly v. Ray D. Hilderman & Co., 225 Neb. 662, 668, 407 N.W.2d 751, 756 (1987), the Nebraska Supreme Court held that a covenant not to compete in an employment agreement "may be valid only if it restricts the former employee from working for or soliciting the former employer's clients or accounts with whom the former employee actually did business and has personal contact." (Emphasis supplied.)

See, also, Boisen v. Petersen Flying Serv., 222 Neb. 239, 383 N.W.2d 29 (1986) (holding that covenant not to compete was unreasonable and unenforceable in part because employee had no personal and business-based contact with employer's customers or prospective customers). The permissible scope of a covenant not to compete ancillary to the sale of a business is not as narrowly limited. You can see our earlier blog posting on this issue here.

Even where such a sale involves a list of specifically identified customers, there may be legitimate reasons why the purchaser must also restrict the seller from competing in a reasonably defined geographic area in order to protect the benefit of his bargain. However, such reasons must be shown in order to establish the reasonableness of a geographic restriction. There must be evidence in the record to support the contention that the seller must be restrained from competing in areas which he served prior to the sale in order to protect the value of the goodwill and trade name purchased.

The book is a collection of his best motivational vignettes that are broadcast on hundreds of radio stations across the country each week on the Radio America Network since May 2011. He also appears daily on The Good Morning Show with Gary Sadlemyer on 1110KFAB for the past 3.5 years.
